Additional services may be offered at our discretion.
2. SERVICE ELIGIBILITY
You must:
- Be legally authorized to manage or own the website submitted for services.
- Provide accurate information during the onboarding process.
- Grant the necessary access required to perform the requested services.
We reserve the right to refuse services where ownership or authorization cannot be reasonably verified.
3. WEBSITE ACCESS REQUIREMENTS
Certain services require administrative access to:
- WordPress dashboards
- Hosting control panels
- DNS providers
- Cloudflare accounts
- Backup services
Clients are responsible for providing accurate credentials.
Shinde Web Care is not responsible for delays resulting from incomplete or incorrect access information.
4. WEBSITE HEALTH SCANS
Website Health Scans are informational services intended to provide a high-level overview of website health.
They:
- Are not penetration tests.
- Are not compliance certifications.
- Do not guarantee complete vulnerability detection.
- Are intended for informational and advisory purposes.
5. WEBSITE SECURITY AUDITS
Website Security Audits are professional assessments designed to identify common vulnerabilities, misconfigurations, and security concerns.
However:
- No security audit can guarantee the identification of every vulnerability.
- Security findings are based on publicly accessible information and authorized testing methods.
- Security reports represent findings at the time of assessment only.
Websites may become vulnerable after the audit due to future software updates, newly disclosed vulnerabilities, or configuration changes.
6. WORDPRESS HARDENING
WordPress Hardening services are intended to improve the overall security posture of a website.
Security hardening significantly reduces risk but cannot guarantee that a website will never be compromised.
No cybersecurity service can guarantee absolute protection from:
- Zero-day vulnerabilities
- Third-party compromises
- Hosting provider breaches
- Human error
- Credential theft
- Social engineering attacks
7. EMERGENCY MALWARE CLEANUP
Emergency Malware Cleanup services are provided on a best-effort basis.
Pricing varies depending on:
- Severity of infection
- Website size
- Recovery complexity
- Backup availability
Certain severely compromised websites may require:
- Partial restoration
- Complete restoration from backups
- Website rebuild recommendations
We do not guarantee recovery if:
- No usable backups exist.
- Hosting environments are irreparably compromised.
- Third-party services prevent remediation.
8. SUBSCRIPTION SERVICES
Monthly plans are billed on a recurring basis unless otherwise agreed.
Subscription services include only the features specifically mentioned within the selected plan.
Services not explicitly listed are considered outside the scope of the subscription.
9. PAYMENT TERMS
Clients agree to:
- Pay invoices before service commencement unless otherwise agreed.
- Complete recurring payments on time.
- Pay any applicable taxes or transaction fees.
Late payments may result in:
- Service suspension.
- Delayed support.
- Cancellation of recurring services.
10. REFUND POLICY
Due to the nature of digital and professional services:
- Completed services are non-refundable.
- Security assessments and consultation services are non-refundable once delivered.
- Refund requests will be reviewed on a case-by-case basis.
11. CLIENT RESPONSIBILITIES
Clients are responsible for:
- Maintaining ownership of their website.
- Providing accurate information.
- Maintaining secure credentials.
- Following recommended security practices.
Failure to implement recommendations provided in our reports may affect website security and performance.
12. SERVICE LIMITATIONS
Unless specifically agreed in writing, our services do NOT include:
- Custom software development.
- Website redesign.
- 24/7 security operations center services.
- Legal compliance certifications.
- Penetration testing of third-party systems.
- Guaranteed search engine rankings.
- Guaranteed malware immunity.
13. LIABILITY DISCLAIMER
To the maximum extent permitted by law:
Shinde Web Care shall not be liable for:
- Business interruptions.
- Data loss.
- Revenue loss.
- Third-party attacks.
- Hosting failures.
- Software vulnerabilities.
- Service provider outages.
- Search engine penalties.
- Consequential damages arising from the use of our services.
Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
14. INTELLECTUAL PROPERTY
All reports, templates, branding materials, and documentation produced by Shinde Web Care remain our intellectual property unless otherwise agreed.
Clients receive a license to use the reports and deliverables for their internal business purposes.
15. ACCEPTABLE USE
Clients may not:
- Use our services to assess websites they do not own or manage.
- Request services intended for unlawful or malicious purposes.
- Misrepresent ownership of websites submitted for review.
16. SUPPORT AND RESPONSE TIMES
Support response times are estimates and may vary based on:
- Service plan.
- Request volume.
- Holidays.
- Emergency incidents.
Response times do not constitute guaranteed resolution times.
17. FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control, including:
- Internet outages.
- Hosting failures.
- Natural disasters.
- Government restrictions.
- Cyber incidents affecting infrastructure providers.
18. MODIFICATIONS TO SERVICES
We reserve the right to modify, improve, or discontinue any service offering at any time.
19. CHANGES TO THESE TERMS
These Terms may be updated periodically. Continued use of our services constitutes acceptance of the revised Terms.
20. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts located in Maharashtra, India.
